Murder trial reset in 2009 Deer Run shooting

Akron -- The trial of a 39-year-old Glenwillow man accused of murder in the April 2009 fatal shooting of his wife has been reset for March 9 at 9 a.m.

Matthew Terrion pleaded not guilty May 22, 2009, to one count of murder, one count of tampering with evidence and one count of misdemeanor domestic violence in connection with the death of 34-year-old Cherilyn Terrion, of Deer Run apartments in Twinsburg.

At hearing last month, Summit County Court of Common Pleas Judge Patricia Cosgrove moved the trial from Jan. 12 to March 9 after ruling on a defense motion that asked the court to exclude evidence recovered from Matthew Terrion's home computers.

Cosgrove ruled against excluding the computer evidence in its entirety, and a meeting between computer expert Alan Buxton, of the Ohio Bureau of Criminal Investigation in Richfield, and defense attorneys Don Malarcik and Scott Rilley will be scheduled to discuss what computer evidence will be presented at trial.

The trial was reset to allow time for a report of that meeting, by the defense, to be provided to the court and prosecution.

That meeting will take place "prior to Feb. 5," according to court documents.

Summit County Prosecutor's Office spokespersons have said the prosecution, in this case prosecutor Terri Burnside, will not comment on open cases.

According to Malarcik, the defense hopes to pare down the computer evidence. Malarcik said Feb. 1 there is a 1,500-page document detailing the lengthy computer investigation.

"This was a six-month investigation of his computers," Malarcik said. "We need the state to explain what they intend to talk about [at trial]. We want to meet this new trial date."

A final pretrial also was set at the Jan. 6 hearing for Feb. 22 at 10:45 a.m.

Cherilyn Terrion's body was discovered April 30 by Twinsburg police at her Deer Run apartment on Darrow Park Drive with a single gunshot wound to the head, according to Gary Guenther, a spokesperson with the Summit County Medical Examiner's Office.

Her death was ruled a homicide, Guenther has said.

Twinsburg police have said there were signs of foul play at the apartment, where a 9 mm handgun was recovered during the investigation.

Cherilyn Terrion had recently moved out of her husband's Glenwillow home, although the couple was still married, according to police. She leaves behind two sons, 2 and 5.

Terrion was arrested May 1, 2009, by Twinsburg police at his Pergl Road home in Glenwillow without incident.

According to Glenwillow Chief Robert Hagquist, Terrion served as a part-time police officer in the village of Glenwillow from August 1993 through August 1994.

Terrion remains in Summit County jail on a $1 million cash bond.
